Terms of service
OVERVIEW
Welcome to ROUTINE! ROUTINE is the trading name of Arife Erdogan, a sole proprietor, established at Sint Stefaansstraat 64, 1932 Zaventem, Belgium, registered under Belgian enterprise number 1037.821.014. The terms “we”, “us” and “our” refer to this business.
ROUTINE operates this store and website, including related content, features, tools, products and services (the “Services”). Our store is powered by Shopify.
These Terms of Service and the policies referenced below describe the terms applicable to your use of our Services and purchases from us. Please read them before placing an order.
Our Privacy Policy explains how we process personal information. It is an information notice, not a request for blanket consent to all processing. Where consent is required, it will be requested separately.
Nothing in these Terms limits mandatory consumer rights under applicable law. For purchases, the version of these Terms provided when you place your order applies.
SECTION 1 - ACCESS AND ACCOUNT
To place an order, you must have the legal capacity to enter into a purchase contract. Where required by applicable law, minors must have the consent of their parent or legal guardian.
You agree to provide correct, current and complete contact, billing, payment and delivery information and to use only payment methods you are authorised to use.
If you create an account, keep your credentials secure and notify us promptly if you suspect unauthorised use. You may not transfer or sell your account. Your responsibility for account activity is determined under applicable law.
SECTION 2 - OUR PRODUCTS
ROUTINE offers activewear. Product characteristics, composition, available sizes, colours and care instructions are described on the relevant product pages or labels.
We aim to display our products accurately. Screen settings and lighting may cause minor differences in how colours appear. This does not affect your right to receive goods that conform to their description and applicable legal requirements.
Please consult the size information before ordering and follow the care instructions provided with your items.
We may update product listings, discontinue products or introduce reasonable purchase limits for future orders. Changes will not alter the characteristics or rights agreed for orders already accepted.
SECTION 3 - ORDERS
Before submitting an order, please check the items, quantities, sizes, delivery address and total price. Submitting an order creates an obligation to pay the total shown at checkout.
Your order is accepted when we send confirmation expressly accepting it. An automated acknowledgement of receipt alone does not constitute acceptance unless it expressly states otherwise.
Before acceptance, we may decline an order for legitimate reasons such as stock unavailability, unsuccessful payment or reasonable suspicion of fraud. We will notify you and refund any payment taken for an order we do not accept. We will not change an accepted order without your agreement except where applicable law permits it.
If you would like to cancel or change an order, contact support@routine-wear.com promptly. We may be unable to stop dispatch once processing has begun. This does not affect your statutory right of withdrawal.
You have 14 calendar days, starting the day after receiving your goods, to notify us of your decision to withdraw without giving a reason. You then have a further 14 calendar days to send the goods back. Details, including applicable return costs and the model withdrawal form, are provided in our Return and Refund Policy.
SECTION 4 - PRICES AND BILLING
Prices shown to consumers in the European Union include applicable VAT and other applicable taxes. Delivery charges and any additional charges payable to us will be clearly displayed before you submit your order. The total shown at checkout is the amount payable to us for your order.
Prices, discounts and promotions may change for future orders. Such changes do not alter the price of orders already accepted.
Available payment methods are displayed at checkout. You must provide accurate billing details and be authorised to use your selected payment method.
Any promotion-specific terms will be made available with the offer and will not reduce mandatory consumer rights.
SECTION 5 - SHIPPING AND DELIVERY
Available destinations, delivery methods, charges and estimated delivery times are set out at checkout and in our Shipping Policy.
We will deliver within the period agreed when you order or, if no period is agreed, without undue delay and no later than 30 days after the contract is concluded. If delivery is delayed, contact support@routine-wear.com. Your rights to require delivery within an additional reasonable period or to terminate the contract and receive a refund are preserved under applicable law.
We remain responsible for the goods during delivery. Risk of loss or damage passes to you when you, or a third party you designate other than the carrier, takes physical possession of the goods. If you independently appoint a carrier we did not offer, the statutory exception concerning transfer of risk applies.
Carrier delays or events outside our control do not automatically remove your statutory rights. If a parcel arrives damaged or an item is missing, contact us so we can investigate and arrange an appropriate remedy.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by ROUTINE, its affiliates or licensors and are protected by applicable copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of ROUTINE, Shopify or any third party. Unauthorized use of the Services may be a violation of applicable intellectual property laws. All rights not expressly granted herein are reserved by ROUTINE.
ROUTINE's names, logos, product and service names, designs, and slogans are trademarks of ROUTINE or its affiliates or licensors. You must not use such trademarks without the prior written permission of ROUTINE. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
This section does not restrict uses permitted by mandatory law, including applicable statutory exceptions.
SECTION 7 - OPTIONAL TOOLS
Our Services may include optional tools supplied by third parties. Their functionality and availability may depend on those providers. Where separate provider terms apply, review them before using the tool.
We do not endorse all content or functions provided through optional tools. However, using a third-party tool does not remove our responsibilities or your mandatory rights concerning your purchase, personal information or the Services under applicable law.
SECTION 8 - THIRD-PARTY LINKS
Our website may contain links to third-party websites. Those websites operate under their own terms and privacy notices. Please review them before sharing information or making purchases there.
We do not control independent third-party websites. Our responsibility for third-party content and links is determined under applicable law. Nothing in this section excludes our responsibility for our own acts or omissions or reduces your mandatory rights.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
ROUTINE is powered by Shopify, which enables us to provide the Services to you. Purchases made in our store are made directly with ROUTINE as the seller, rather than with Shopify. ROUTINE is responsible for fulfilling its seller obligations concerning your order.
The respective responsibilities of ROUTINE and Shopify are determined under applicable law. This section does not waive mandatory consumer rights or exclude liability that cannot legally be excluded.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. These notices explain applicable data processing and your rights. Where consent is legally required, it will be requested separately.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our Privacy Policy for more details on how we, Shopify, and our partners use your personal information.
Any international transfer of personal information will be subject to the safeguards required by applicable data protection law.
SECTION 11 - FEEDBACK
If you submit a review or other content for publication on our Services, you give us a non-exclusive, royalty-free licence to display that content and make necessary formatting changes for the purpose for which it was submitted. We will obtain any additional permission required for other uses, including marketing uses of identifiable photographs or personal content.
You must own or have permission to use the content you submit, disclose any incentive received for a review, and avoid unlawful, misleading or abusive content or content that infringes another person's rights.
We may remove content for legitimate reasons, including unlawful content, spam or infringement. We will not manipulate reviews or remove genuine reviews solely because they are negative. Personal information is handled under our Privacy Policy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We may correct errors in product listings, prices, availability or other website information. Corrections normally apply to future orders.
If an error affects your order, we will contact you to explain it and propose a solution. We will not impose a changed price or different product on you without your agreement. Any cancellation of an accepted order will be subject to applicable law, and any amounts due to you will be refunded without undue delay.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm ROUTINE, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use automated scraping or extraction tools in a way that infringes rights, disrupts the Services or circumvents access restrictions; any permitted Agent access must comply with Section 14; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. Any suspension or termination will be handled in accordance with Section 15 and applicable law.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 15 - TERMINATION
We may restrict or suspend access to an account where reasonably necessary to address fraud, security risks, unlawful conduct or a serious breach of these Terms. Where appropriate, we will explain the reason and allow you to resolve the issue. Immediate action may be taken where justified by the seriousness of the situation.
Suspension or closure of an account does not remove our obligations concerning existing purchases, refunds, statutory guarantees or personal information. Provisions that necessarily continue after account closure remain applicable subject to mandatory law.
SECTION 16 - STATUTORY GUARANTEES AND WEBSITE AVAILABILITY
Goods sold to consumers are covered by the applicable statutory guarantee of conformity. Under Belgian law, new goods are generally covered for two years from delivery. Where the legal conditions are met, you may request repair or replacement free of charge, or a price reduction or refund in the circumstances provided by law.
This guarantee is separate from your 14-day right of withdrawal. Contact support@routine-wear.com if an item is defective or does not conform to your order. Nothing in these Terms excludes or limits statutory guarantees.
We aim to keep our website available and accurate, but access may occasionally be interrupted for maintenance or technical reasons. Such interruptions do not affect your rights relating to orders already placed.
SECTION 17 - LIABILITY
Our liability and your rights to compensation are determined under applicable law.
Nothing in these Terms excludes or limits liability where doing so is prohibited by law, including liability for fraud, intentional misconduct, gross negligence, or death or personal injury caused by our acts or omissions. These Terms do not exclude liability for failure to perform our essential contractual obligations or remove mandatory consumer remedies.
SECTION 18 - RESPONSIBILITY FOR UNLAWFUL USE
You are responsible, to the extent established under applicable law, for harm caused by your unlawful use of the Services or infringement of another person's rights.
This section does not impose automatic indemnification, disproportionate penalties or automatic payment of legal fees. Any claim and recoverable costs must be assessed under applicable law and do not remove your right to contest them.
SECTION 19 - SEVERABILITY
If a provision of these Terms is unlawful or unenforceable, it will not bind you. The remaining provisions continue to apply to the extent that the contract can continue under applicable law. An unfair consumer term will not be rewritten or enforced merely to make it more favourable to us.
SECTION 20 - WAIVER; CONTRACT DOCUMENTS
A failure or delay in exercising a right does not automatically waive that right.
These Terms, the policies referenced in them and the information supplied when you place your order form the contractual documentation for your purchase. They do not exclude binding pre-contractual information, express commitments we have made or mandatory legal rights.
Any ambiguity in a consumer contract will be interpreted in the consumer's favour as required by applicable law.
SECTION 21 - ASSIGNMENT
Any transfer of rights or obligations under these Terms must comply with applicable law. We will not transfer a contract in a way that reduces your guarantees or other rights. Where your consent is legally required, we will obtain it, and we will notify you of a transfer where required.
SECTION 22 - GOVERNING LAW AND DISPUTES
These Terms and purchases from ROUTINE are governed by Belgian law. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections available under the law that would otherwise apply to your contract.
Please first contact support@routine-wear.com about any complaint so that we can seek a solution. This does not prevent you from using available consumer dispute resolution procedures or bringing proceedings before a court with jurisdiction under applicable law, including courts in your country of residence where consumer jurisdiction rules permit this.
SECTION 23 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
The current version of these Terms is available on this page. We may update these Terms for future use of the Services or future orders, for example to reflect changes in law, our Services or business operations.
Updates will not retrospectively change the terms of orders already accepted. Material changes affecting an ongoing service will be notified as required by applicable law. Continued browsing will not be treated as consent to changes that legally require your express agreement.
SECTION 25 - CONTACT INFORMATION
Questions or complaints concerning these Terms or your order should be sent to support@routine-wear.com.
